Terms of Service

CoMarker is an AI-assisted essay and assignment marking tool for teachers and students. It allows users to upload student work and rubrics to receive automated, criterion-aligned feedback and grades. CoMarker is provided as a software-as-a-service (SaaS) platform.

You must be at least 18 years old to create a CoMarker account. Teachers creating accounts on behalf of a school or institution represent that they are authorised to do so.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at hello@comarker.com.au if you suspect unauthorised access.

CoMarker offers the following plans:

• Free — 3 lifetime grading uses at no cost.
• Pro — 62 markings per month at $12.99 AUD/month (monthly billing) or $10.66 AUD/month (annual billing, billed as $127.92 AUD/year).
• School — custom pricing for departments and institutions. Contact us for a quote.

Subscriptions are billed in advance. You may cancel at any time; cancellation takes effect at the end of the current billing period and you will not be charged again. No refunds are issued for partial billing periods unless required by applicable law.

We reserve the right to change pricing with 30 days' notice to existing subscribers.

You agree not to:

• Use CoMarker to grade content that is illegal, harmful, or violates the rights of others
• Attempt to reverse-engineer, scrape, or extract the underlying AI models or systems
• Resell or sublicense access to CoMarker without our written permission
• Submit work belonging to students without appropriate consent or authority
• Use automated scripts to access the service beyond normal use
• Attempt to circumvent usage limits or access controls

We reserve the right to suspend or terminate accounts that violate these terms without notice.

CoMarker uses artificial intelligence to generate marking feedback and grades. AI output is not infallible. Marks and comments generated by CoMarker are intended as a tool to assist teachers — they do not constitute a final, authoritative assessment.

Teachers remain fully responsible for reviewing, adjusting, and approving any grades or feedback before they are communicated to students. CoMarker is a marking aid, not a replacement for professional teacher judgement.

CoMarker and its underlying technology, branding, and content are owned by us and protected by Australian and international intellectual property laws.

You retain ownership of all content you upload (student work, rubrics, task sheets). By uploading content, you grant us a limited licence to process that content solely for the purpose of providing the grading service. We do not claim ownership of your content and do not use it to train AI models.

Your use of CoMarker is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

CoMarker is provided “as is” and “as available” without warranties of any kind, express or implied — including warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the service will be uninterrupted, error-free, or that AI-generated feedback will be accurate, complete, or suitable for any particular purpose.

To the maximum extent permitted by Australian law, CoMarker and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, lost profits, or reputational harm, arising from your use of the service.

Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.

You may close your account at any time by contacting us. We may suspend or terminate your access if you breach these Terms, if we discontinue the service, or if required by law. Upon termination, your right to use CoMarker ceases and your data will be deleted in accordance with our Privacy Policy.

These Terms are governed by the laws of New South Wales, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of New South Wales.

We may update these Terms from time to time. We will notify registered users of material changes by email at least 14 days before they take effect. Continued use of CoMarker after the effective date constitutes acceptance of the updated Terms.
